What is the difference between Fasakh and Khulu' divorce?
Fasakh is a dissolution of marriage ordered by the Syariah Court on grounds recognised by Islamic law, such as failure to provide maintenance or cruelty. Khulu' (tebus talak) is a divorce at the wife's request in exchange for compensation agreed with the husband. Our Syarie Counsel will advise which route suits your circumstances.
How is a deceased Muslim's estate distributed in Malaysia?
A Muslim estate is distributed according to Faraid, the Islamic law of inheritance, unless valid instruments such as a Wasiah (Islamic will, up to one-third of the estate) or Hibah (gift) apply. We assist with Faraid applications and disputes, Wasiah, Hibah confirmation and the appointment of estate administrators.
Can you represent me in child custody (Hadhanah) proceedings?
Yes. Our Syariah Department handles child custody, maintenance, access and visitation, and legitimacy matters before the Syariah Courts, and also assists with reconciliation where the parties wish to attempt it.
